Texas DA Seeks Justice for Jocelyn Nungaray: Death Penalty Pursued for Accused Migrant Criminals

Former Harris County District Attorney Kim Ogg is sending a clear message that criminals, regardless of their origin, will face consequences for their actions in Texas. This follows the tragic murder of 12-year-old Jocelyn Nungaray, where two individuals allegedly affiliated with the Tren de Aragua gang, Franklin Pena and Johan Martinez-Rangel, are accused of rape and murder. Ogg, before leaving office, has declared her intention to seek the death penalty for the accused.

In an interview with Fox & Friends, Ogg emphasized that the brutality of the crime demands justice and that the suspects' immigration status will not shield them from the full extent of the law. She stated their illegal entry into the U.S. from Venezuela, according to ICE, constitutes their "first crime," further highlighting that they were released after being apprehended.

Jocelyn's mother, Alexis Nungaray, continues to advocate for stricter border policies, believing they contribute to such tragedies. She has framed the issue as one of "human value" rather than political affiliation. Jocelyn's grandfather, Kelvin Alvarenga, also expressed his grief and hope that no other family endures similar pain, emphasizing the devastating impact of such crimes within the Latino community.

Ogg's decision to pursue the death penalty stems from the horrific nature of the crime and consultations with the Nungaray family. She believes this is the just response under Texas law for such an act against a child.
