Boise State's withdrawal, announced shortly after their victory against Utah State in the tournament's first round, follows their previous forfeitures of regular season matches against SJSU. Utah State had also forfeited their single regular season match against the Spartans.

SJSU now awaits the winner of the semifinal match between top-seeded Colorado State and No. 5 San Diego State. Neither of these teams forfeited their regular season games against SJSU.

Several Mountain West teams, including Boise State, Wyoming, Utah State, and Nevada, opted out of playing against the Spartans due to Fleming's inclusion on the team. These forfeitures, which counted as losses for the forfeiting teams, contributed to SJSU's high seeding in the tournament.
A recent legal challenge to Fleming's participation was unsuccessful. A federal judge in Colorado denied a motion for injunctive relief sought by a group of college volleyball players who sued the Mountain West conference. The players aimed to bar Fleming from competing in the tournament and have their forfeit losses overturned. The lawsuit alleges violations of Title IX and the players' First Amendment rights. The plaintiffs include SJSU co-captain Brooke Slusser, two former Spartans, and athletes from other Mountain West schools.
