Presidential hopeful Vivek Ramaswamy has criticized the media for allegedly favoring President Biden by sidestepping questions about his potential involvement in the Trump indictment. To address this perceived lack of transparency, Ramaswamy has submitted a Freedom of Information Act (FOIA) request, seeking disclosure of communications between the White House and the Justice Department regarding the second indictment of former President Donald Trump.
Ramaswamy's objective is to uncover the specifics of any White House communication with Attorney General Merrick Garland and Special Counsel Jack Smith concerning the indictment of Trump, whom he describes as Biden's political rival. He emphasized the importance of public access to this information, stating that if the media fails to fulfill its role, leaders must step up.

Ramaswamy, a contender in the growing field of Republican candidates, acknowledges that Trump's removal from the race would simplify his own path to the White House. However, he maintains that such an outcome would not serve the nation's best interests.
Trump is facing 37 charges related to the handling of classified documents, including obstruction of justice and making false statements. Ramaswamy has reiterated his commitment to pardon Trump if elected president.

In a recent television interview, Ramaswamy questioned the communication between Biden and Garland, and Garland and Smith, characterizing the indictment as highly politicized. He pointed to what he views as selective use of evidence and omission of key facts and legal considerations, further reinforcing his perception of political motivation.

Last year, Attorney General Garland appointed Jack Smith, a seasoned prosecutor with experience in war crimes and public corruption cases, to oversee investigations into the classified documents found at Trump's Florida residence and aspects of the January 6th Capitol riot investigation. Smith’s appointment was meant to address the political sensitivities surrounding an investigation into a former president and current presidential candidate. President Biden has stated he has not communicated with Garland regarding the case.
Special counsels are appointed when the Justice Department identifies a conflict of interest or when it’s in the public interest to have an external party manage a sensitive matter. The Code of Federal Regulations stipulates that special counsels must possess a strong reputation for integrity, impartial judgment, and a thorough understanding of criminal law and Justice Department protocols.
