He had been serving a 14-year sentence stemming from an August 2021 arrest at a Russian airport for possessing what his family maintains was medically prescribed marijuana.
Last year, prior to a rally in Butler, Pennsylvania, Malphine Fogel personally appealed to then-presidential candidate Trump, urging him to remember her son's plight. He reassured her that he would prioritize Marc's return home.

Reflecting on her meeting with Trump, Malphine Fogel described him as exceptionally gracious and emphasized his repeated promise to secure her son's release if elected. She believes Trump's involvement was crucial to the successful outcome. In addition to thanking Trump, she also expressed appreciation for Secretary of State Marco Rubio and others who contributed to the effort.
Overwhelmed with joy, Malphine Fogel recounted the surprise of receiving a call from her son informing her of his presence at the Moscow airport, signaling his imminent departure from Russia. She admitted to feeling increasingly optimistic in the preceding days, despite not having heard from Marc for a week. The call came as a welcome shock.
