Georgia Judge Rules State Lawmakers Can Subpoena DA Fani Willis

Created: JANUARY 26, 2025

A Georgia judge has determined that state legislators possess the authority to subpoena Fulton County District Attorney Fani Willis. This decision comes as part of an ongoing investigation into potential misconduct during Willis's prosecution of former President Donald Trump.

Judge Shukura Ingram of the Fulton County Superior Court issued the order on December 23, 2024, granting Willis until January 13, 2025, to submit any objections or claims of privilege related to the subpoenaed materials. Willis has indicated her intention to appeal the ruling, with her legal representative, former Georgia Governor Roy Barnes, stating their belief that the decision is erroneous.

This development follows an earlier appeals court decision to remove Willis and her team from the Georgia election interference case involving Trump, citing concerns about impartiality. The court specifically referenced a relationship between Willis and Special Prosecutor Nathan Wade as contributing to the perceived conflict of interest. Trump criticized the case as a politically motivated attack orchestrated by the Biden administration.

The Republican-led Senate committee initially issued subpoenas to Willis in August, requesting her testimony regarding allegations of misconduct in her pursuit of Trump related to the 2020 election results in Georgia. Willis did not appear at a hearing scheduled for September. Willis's attorney argued that the subpoenas were excessively broad, lacked a valid legislative purpose, and that the committee overstepped its authority. A key point of contention revolves around the expiration of the Georgia legislative term on January 13, 2025, when new lawmakers are sworn in. Republican State Senator Greg Dolezal has expressed his intention to re-establish the committee in the upcoming 2025 legislative session, aiming to continue the inquiry.
