Lawyer Leading FBI Agents' Lawsuit Against DOJ Has Long History of Anti-Trump Legal Action

Created: JANUARY 27, 2025

Representing anonymous FBI agents in their lawsuit against the Department of Justice to prevent public identification is a lawyer with a notable history of opposing former President Trump. This attorney, Norm Eisen, has been involved in several high-profile legal challenges against Trump.

Eisen boasts a diverse resume, including roles as a CNN legal analyst, an expert at the Brookings Institution, former U.S. ambassador to the Czech Republic, and special counsel for ethics and government reform during the Obama administration. His involvement in the current lawsuit stems from his position as executive chair of the State Democracy Defenders Fund, a non-profit organization dedicated to combating election interference and authoritarianism.

The State Democracy Defenders Fund filed the lawsuit on behalf of the FBI agents involved in investigations related to Trump. The lawsuit alleges that the FBI has been instructed to dismiss employees involved in Trump-related investigations and that their names might be publicly released. Eisen's organization sought an emergency order to prevent this disclosure.

Eisen's history of legal action against Trump includes serving as co-counsel for the House Judiciary Committee during Trump's first impeachment proceedings. He played a key role in developing the articles of impeachment, which focused on abuse of power and obstruction of Congress related to alleged foreign interference in the 2020 election.

Following the impeachment, Eisen disclosed that he had initially drafted ten articles of impeachment, covering a broader range of issues. While the "hush money" payments to Stormy Daniels were not included in the final articles, they later became central to the Manhattan v. Trump trial, in which Trump was found guilty of falsifying business records.

Eisen has defended his actions against Trump, stating that while he was initially open to working with the Trump administration, he felt compelled to act due to what he perceived as Trump's unconstitutional actions.

Beyond the impeachment proceedings, Eisen has been involved in other legal challenges targeting Trump. He co-founded Citizens for Responsibility and Ethics in Washington, an organization that initiated a lawsuit seeking to remove Trump from the Colorado primary ballot based on the 14th Amendment's insurrection clause. Although this effort was unsuccessful, it highlights Eisen's continued involvement in legal battles against Trump.

The State Democracy Defenders Action, co-founded by Norm Eisen, center, has been involved with other Trump-involved court cases, including in the Manhattan v. Trump case.

Eisen's State Democracy Defenders Action also participated in the Manhattan v. Trump case, filing an amicus brief advocating for Trump's sentencing. Furthermore, he founded the States United Democracy Center, which filed an amicus brief in the Fulton County, Georgia, racketeering case against Trump. Eisen also expressed concerns about Kash Patel's nomination as FBI director under the second Trump administration, citing ethical concerns related to Patel's previous work in Qatar.

The current lawsuits filed by the FBI agents aim to prevent the collection and release of their names following a memo directing the FBI to dismiss employees involved in the January 6th investigation and a Hamas-related terror case. Eisen has emphasized the need to protect the rights and privacy of these agents.
