Kohberger's Defense Seeks More Time for Alibi Notice in Idaho Student Murders Case

Created: JANUARY 24, 2025

Bryan Kohberger's legal team is requesting additional time to provide the state with notice of an alibi in the ongoing Idaho student murders case. Kohberger, 28, stands accused of the November 13, 2022, killings of University of Idaho students Madison Mogen, 21; Kaylee Goncalves, 21; Xana Kernodle, 20; and Ethan Chapin, 20, in their off-campus residence.

The defense's request follows a May 26 motion by Idaho prosecutors demanding alibi notification. According to the Idaho Supreme Court, an alibi constitutes evidence demonstrating the defendant's absence from the crime scene at the time of the alleged offense.

Defense attorney Anne Taylor argued in a recent filing that the prosecution has presented a massive amount of data, including 51 terabytes of information, encompassing thousands of pages of discovery, thousands of photographs, hundreds of hours of recordings, and gigabytes of phone and social media data. She described the discovery process as "voluminous and ongoing."

Taylor stated that the defense needs more time to thoroughly examine the evidence before providing an alibi notice, characterizing such a notice at this stage as "premature." The defense team, she added, is actively investigating the charges against Kohberger while simultaneously navigating the extensive discovery provided by the state.

Kohberger, a criminology Ph.D. student at Washington State University, is alleged to have driven to the victims' residence near the University of Idaho campus and fatally stabbed the four students. Two other roommates, who were on the first floor, were reportedly unharmed. Investigators believe Kohberger's vehicle took a circuitous route back to his apartment in Pullman, Washington, and was observed near the crime scene later that same day.

Kohberger was apprehended at his family's Pennsylvania residence on December 30, 2022. He has pleaded not guilty to four counts of first-degree murder and one count of felony burglary. His trial is tentatively scheduled for early October, but this date may be subject to change if the defense waives his right to a speedy trial.
